JACKSON, Miss. (AP) — Mississippi's former corrections commissioner is asking a federal judge to reconsider the decision to jail him.
In a motion filed Tuesday, Christopher Epps asks U.S. District Judge Henry T. Wingate to release him until his May 24 sentencing.
Wingate revoked Epps' bail Nov. 4 after Epps was charged with stealing outdoor lights and a control box from the house he forfeited to the federal government. The judge said he believed there were no conditions that would guarantee Epps wouldn't commit another crime.
John Colette, Epps' lawyer, argues that he's not a flight risk and that Wingate could set conditions assuring Epps would appear for sentencing and not threaten community safety.
Epps testified he mistakenly took the lights because he didn't understand or forgot he could no longer remove belongings.
